Remember how we've always said caregivers in California are never, ever independent contractors? Well apparently a registry, also known as a direct referral agency, didn't get this message. This registry misclassified the caregivers as independent contractors, and also didn't follow the requirements of California law to operate correctly as a registry. Thus, the registry was considered the employer and fined for failing to pay minimum wage, overtime and misclassification. Don't let this happen to you! Whether you're an agency or a family employing a caregiver directly, that caregiver is ALWAYS your employee, not an independent contractor.
